1. Acceptance of terms

By accessing or using solvedpm.com, any subdomain, landing page, or other website operated by Solved Property Management (collectively, the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the Site.

These Terms apply to all visitors, prospective clients, prospective tenants, current clients, and any other person who accesses the Site.

2. About us

The Site is operated by Solved Property Management, located at 104 Crockford Blvd., Unit 214, Scarborough, ON M1R 3C3.

Solved Property Management provides residential property management services to property owners in Ontario, Canada. Solved Property Management is not a Real Estate brokerage. Where MLS listing services, tenant placement on MLS, or sale and purchase representation are required, those services are provided under separate written agreements with Royal LePage Signature Realty, Brokerage, and performed by licensed Real Estate Salespersons or Brokers registered with that brokerage. Those activities are governed by the Real Estate Council of Ontario (RECO) and the Trust in Real Estate Services Act, 2002 (TRESA).

3. Scope of these Terms

These Terms govern your use of the Site only. They do not constitute an agreement for property management, tenant placement, leasing, or any brokerage services.

Provision of services by Solved Property Management or by Royal LePage Signature Realty, Brokerage, is governed exclusively by separate written agreements, which may include:

  • Property Management Services Agreement, signed between Solved Property Management and the property owner.
  • Tenancy Agreement, signed between the property owner and the tenant in the form required by the Residential Tenancies Act, 2006.
  • Listing Agreement, signed between Royal LePage Signature Realty, Brokerage, and the property owner for MLS listing services.
  • Tenant Representation Agreement, signed between Royal LePage Signature Realty, Brokerage, and a prospective tenant.

In the event of any conflict or inconsistency between these Terms and a signed services agreement, the terms of the signed services agreement govern with respect to the services described.

Nothing on the Site, including pricing information, calculators, marketing offers, blog content, or testimonials, constitutes an offer to enter into a binding agreement. A binding agreement is formed only upon execution of the applicable written services agreement by both parties.

4. Use of the Site

You agree to access and use the Site only for lawful purposes and in a manner consistent with these Terms. You will not:

  • Use the Site in any way that violates applicable law, regulation, or third-party rights.
  • Submit false, misleading, or fraudulent information through any form on the Site, including inquiry forms, quote requests, or rental applications.
  • Use the Site to transmit viruses, malware, or any harmful code.
  • Attempt to gain unauthorized access to the Site, our servers, our service providers' systems, or any account, network, or system associated with the Site.
  • Scrape, harvest, crawl, or copy content from the Site by automated means without our prior written consent.
  • Reverse-engineer, decompile, or attempt to derive the underlying source code or structure of any part of the Site.
  • Use the Site to send unsolicited commercial communications or to harvest contact information for marketing purposes.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of the Site or the servers and networks that host it.

We reserve the right to investigate suspected violations of these Terms, to suspend or terminate access to the Site for any user who violates them, and to cooperate with law enforcement authorities where required.

5. Inquiries, quotes, and promotional offers

5.1 Inquiries are not contracts

Information submitted through any form on the Site, including contact forms, inquiry forms, quote request forms, lead capture forms on landing pages, and any pricing calculator or interactive estimator, constitutes an inquiry only. Submitting an inquiry does not create a contract for services and does not obligate either you or Solved Property Management to enter into any agreement. Services are provided only after a Property Management Services Agreement (or other applicable written agreement) has been signed by both parties.

5.2 Quotes and estimates

Any pricing, fee, rate, or service description displayed on the Site, including pricing pages, comparison charts, fee calculators, and quote estimates, is provided for general informational purposes only. Actual fees and service terms are determined on a property-by-property basis and are confirmed in the signed Property Management Services Agreement. Estimates displayed on the Site may vary based on factors including property type, location, unit count, condition, tenancy status, complexity of management, and current market conditions.

5.3 Promotional offers

From time to time we may run promotional offers, including "First month on us" or similar introductory offers. Unless explicitly stated otherwise in the offer:

  • Promotional offers apply only to the monthly property management fee.
  • Promotional offers do not apply to tenant placement fees, leasing commissions, maintenance pass-through costs, contractor fees, Landlord and Tenant Board filing and preparation work, or any other service performed by Solved Property Management or by Royal LePage Signature Realty, Brokerage.
  • Promotional offers are valid for new clients only and apply to a single property unless otherwise specified.
  • Promotional offers may be modified, suspended, or withdrawn at any time without notice.
  • The terms of any promotional offer are governed by the signed Property Management Services Agreement, which controls in the event of any conflict with marketing language displayed on the Site.

6. Intellectual property

All content on the Site, including text, graphics, logos, brand names, taglines, photography, video, illustrations, designs, icons, layouts, software, and any other materials (collectively, "Site Content"), is owned by or licensed to Solved Property Management and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

The names "Solved Property Management" and "Solved," along with associated logos and brand elements, are trademarks or trade names of Solved Property Management. You may not use these names or marks without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view Site Content for personal, non-commercial purposes only. You may not, without our prior written consent:

  • Copy, reproduce, republish, distribute, or transmit any Site Content.
  • Modify, adapt, translate, or create derivative works from Site Content.
  • Use any Site Content for commercial purposes, including in marketing materials, presentations, advertising, or competing websites.
  • Frame, mirror, or embed Site Content on any other website or platform.
  • Remove or alter any copyright, trademark, or other proprietary notices on Site Content.

Any feedback, suggestions, or ideas you submit to us about the Site or our services may be used by us without restriction and without compensation to you.

7. Third-party links and content

The Site may contain links to third-party websites, resources, or services, including but not limited to:

  • The Landlord and Tenant Board and other government resources.
  • Royal LePage Signature Realty, Brokerage, and individual licensed agent profiles.
  • Partner trades, contractors, and service providers.
  • Educational resources, news articles, market data sources, and industry publications.
  • Social media platforms and third-party review platforms.

These links are provided for your convenience and information only. We do not control, endorse, or assume responsibility for the content, accuracy, availability, privacy practices, or terms of use of any third-party site or service.

Your access and use of any third-party site or service is at your own risk and is governed by the terms and privacy policies of that third party. We encourage you to review them before providing any information or transacting with a third party.

If you find a link on the Site that is broken, inaccurate, or directs to inappropriate content, please notify us at hello@solvedpm.com so we can review it.

8. Reviews and testimonials

Customer reviews, testimonials, case studies, success stories, and star ratings displayed on the Site are real statements provided by actual current or former clients of Solved Property Management. We obtain consent from clients before publishing their testimonials, and we display their names, initials, or other identifying information only with their permission.

Star ratings, where displayed, reflect aggregate publicly available ratings (such as Google Reviews) at the time of display. Star ratings update periodically and may not reflect the most current rating.

Testimonials describe the individual experience of the client who provided them. Individual experiences vary based on property type, location, market conditions, tenant behaviour, owner involvement, and many other factors. Testimonials are not a guarantee, warranty, or prediction of future performance or results. The fact that a past client had a positive experience does not mean you will have the same experience.

We do not pay or compensate clients for testimonials. From time to time we may offer a small thank-you gesture (such as a coffee gift card) to a client who provides a testimonial, and any such gesture is disclosed where required by Competition Bureau guidelines.

9. Disclaimers

9.1 Site provided "as is"

The Site and all Site Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by Ontario and Canadian law, Solved Property Management disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, and uninterrupted or error-free operation.

9.2 Informational content only

Information displayed on the Site, including market statistics, rent estimates, pricing examples, blog content, case studies, infographics, neighbourhood guides, mortgage calculators, investment calculators, and any other educational or analytical content, is provided for general informational purposes only. It does not constitute and should not be relied upon as:

  • Legal advice.
  • Financial, investment, or tax advice.
  • Mortgage advice.
  • Real Estate advice.
  • Property valuation or appraisal.
  • Insurance advice.

You should always consult a qualified, licensed professional for advice specific to your situation before making any property, financial, or legal decision.

9.3 Market data

Market statistics and data displayed on the Site are drawn from sources we believe to be reliable, including the Toronto Regional Real Estate Board (TRREB), Canadian Real Estate Association (CREA), Canada Mortgage and Housing Corporation (CMHC), Bank of Canada, Statistics Canada, and other publicly available sources. We do not guarantee the accuracy, completeness, or currency of any data drawn from third-party sources. Market conditions change rapidly and historical data is not a guarantee of future performance.

9.4 No agency relationship

Use of the Site does not create a brokerage, agency, fiduciary, advisory, or employment relationship between you and Solved Property Management or between you and Royal LePage Signature Realty, Brokerage. Such relationships are formed only through a signed services agreement as described in §3.

10. Limitation of liability

10.1 Limitation

To the maximum extent permitted by the laws of Ontario and Canada, in no event will Solved Property Management, its owners, directors, officers, employees, agents, contractors, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to damages for lost profits, lost revenue, lost business opportunity, lost data, lost goodwill, business interruption, or any other intangible loss, arising out of or in connection with:

  • Your access to, use of, or inability to access or use the Site.
  • Any errors, omissions, inaccuracies, or outdated information on the Site.
  • Any reliance placed on Site Content.
  • Any unauthorized access to or alteration of your information.
  • Any third-party content, links, or services accessed through the Site.

This limitation applies regardless of the legal theory on which the claim is based (contract, tort, negligence, statute, or otherwise) and regardless of whether we were advised of the possibility of such damages.

10.2 Maximum aggregate liability

To the maximum extent permitted by law, the total aggregate liability of Solved Property Management to you for any and all claims arising out of or relating to your use of the Site will not exceed one Canadian dollar (CAD $1). This limit reflects the fact that no fee is charged for use of the Site and applies only to claims relating to the Site itself. Liability under any signed services agreement is governed by the terms of that agreement.

10.3 Exceptions

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence.

11. Indemnification

You agree to indemnify, defend, and hold harmless Solved Property Management, its owners, directors, officers, employees, agents, contractors, affiliates, and licensors from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees on a substantial indemnity basis) arising out of or in connection with:

  • Your breach of these Terms.
  • Your misuse of the Site or Site Content.
  • Your violation of any applicable law, regulation, or third-party right in connection with your use of the Site.
  • Any false, misleading, or fraudulent information you submit through the Site, including through inquiry forms, quote requests, or rental applications.
  • Your infringement of any intellectual property, privacy, publicity, or other rights of any person or entity in connection with your use of the Site.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you will cooperate with us in asserting any available defenses.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information. The Privacy Policy is incorporated into these Terms by reference and forms part of your agreement with us. By using the Site, you confirm that you have read and understood the Privacy Policy.

If there is any conflict between these Terms and the Privacy Policy with respect to the handling of personal information, the Privacy Policy governs.

13. Modifications

We may amend or update these Terms at any time, in our sole discretion, to reflect changes in our services, technology, legal requirements, or for any other operational reason.

When we make changes, we will revise the "Last updated" date at the top of these Terms. If the changes are material, we may provide additional notice through a prominent notice on the Site or by other reasonable means.

Your continued access to or use of the Site after changes to these Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop accessing and using the Site.

14. Governing law and jurisdiction

These Terms, your use of the Site, and any dispute arising out of or relating to these Terms or the Site are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.

You and Solved Property Management agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in Toronto, for the resolution of any dispute arising out of or relating to these Terms or the Site.

You agree that any claim or cause of action arising out of or relating to these Terms or your use of the Site must be commenced within one (1) year after the claim or cause of action arose, regardless of any longer limitation period that may otherwise apply by law. To the maximum extent permitted by law, you waive any longer limitation period.

15. General provisions

15.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect.

15.2 No waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Solved Property Management.

15.3 Entire agreement

These Terms, together with the Privacy Policy and any signed services agreement, constitute the entire agreement between you and Solved Property Management with respect to your use of the Site and supersede all prior or contemporaneous communications, proposals, or representations, whether oral or written.

15.4 Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms at any time without notice to you, including in connection with a sale, merger, restructuring, or transfer of our business or assets.

15.5 No third-party beneficiaries

These Terms are for the benefit of you and Solved Property Management only. They do not create any rights enforceable by any third party, except for the affiliated parties named in §10 (Limitation of Liability) and §11 (Indemnification).

15.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

15.7 Language

These Terms are drafted in English. Any translation is provided for convenience only, and the English version governs in the event of any discrepancy.
